Title Defects

A title defect means a potential threat to the property’s current owner. In this concern, the owner is unable to claim full rights to sell the property. In title defect, the property has a publicly known issue like mortgage, lien, or possession in which the other party claims the property’s ownership.

Legally, the titleholder is considered the actual owner of the property and reserves all rights of possession. However, the right may be limited in certain scenarios; for example, a titleholder cannot clear the tax or utility dues in the required time. When the titleholder fails to clear such payments, the government places a lien on the property to recover the pending dues.
